Scripted employee meetings – flexibility to deviate

A recent EAT (employment appeals tribunal) case has considered the use of scripts in disciplinary meetings. Employer’s often have scripts written by HR to assist in meetings with the staff. These scripts can be very helpful especially for the employer who is completely unaware of how best to conduct the meeting.

In Alom v The Financial Conduct Authority [2025] EAT the employee was dismissed for gross misconduct. He appealed the original tribunal decision for, among other things, the use of a prepared script which he claimed indicated a predetermined outcome. This point of the appeal failed because the EAT accepted the script did not invite a particular outcome and all evidence was considered by the disciplinary manager before the decision was made.
